PRIVACY STATEMENT
Claudia Dermois Fotografie considers your privacy to be very important. Your personal data will therefore be processed and used in a secure manner, fully in accordance with the General Data Protection Regulation (GDPR). In this privacy statement, I explain which data I collect from you and why I do so. You can also read about your rights regarding this processing. Article 1 – Who am I?
Claudia Dermois Fotografie is a sole proprietorship, established at Lijsterstraat 19, (9422 KB) Smilde, The Netherlands. I am registered with the Chamber of Commerce under number 81468326. I am the data controller responsible for your personal data.
Article 2 – What data do I use?
Below you will find an overview of the data I process, why I process it, the legal basis for doing so, and how long I retain this data.
I process your name, address, email address, phone number, and other information necessary to provide my services to you in the best possible way. This may include special categories of personal data, such as photographs of you and other individuals. I use this information to ensure you are a satisfied client during the term of our agreement. I retain this data for up to 7 years after the end of our agreement.
In the case of coaching services, I document your website, social media accounts, and the progress of our sessions in an electronic file to facilitate the coaching process. With your explicit consent, this file may also include reports of our sessions.
When you place an order for prints or photo products, I process your name, billing address, shipping address, payment details, and photographs. I retain this data for up to 7 years after your last order.
You can log into an online gallery to download photographs. I can see which email address was used to log into the gallery. This information remains visible within Pixieset until I delete the gallery.
I use a portfolio on my website and social media channels to showcase previous work to potential clients. I may process content created for you or of you, including your name and social media account if you have given consent when entering into our agreement. I retain this content indefinitely unless you request its removal, after which a balancing of interests will take place, or unless I clear my archive. You are responsible for making your own backup after delivery of the files.
Edited images are deleted 1 year after the shoot. Unedited material is deleted 6 months after delivery.
For invoicing and financial administration, I process your name, company name if applicable including Chamber of Commerce details, address, email address, phone number, client number, bank details, and outstanding balance. Without this information, I cannot process your payment. In accordance with tax regulations, I am required to retain this data for 7 years. After this period, the data will be deleted or anonymized.
If you submit a complaint regarding my services, I will process your name, email address, order number, and the content of and communication about the complaint in order to provide the best possible solution. This data is used to properly perform the agreement and will be deleted 1 year after the complaint has been resolved.
For direct marketing purposes, I process your name and email address to send you information. I will delete this data once you indicate that you no longer wish to receive communications or unsubscribe from my newsletter.
If I detect an infringement of my copyright, I will compile a file including screenshots of the infringement, your name and company name if applicable, address details for sending a formal notice, and other relevant information necessary to handle the infringement. This data will be deleted no later than one year after the matter has been fully resolved.
To enable and optimize this website, I use analytics and retargeting services. I have a commercial interest in analyzing your browsing behavior and related data in order to improve my services through Google Analytics.
These services use cookies. Cookies are small pieces of information sent to your browser when visiting my website and stored on the hard drive or in the memory of your device. These cookies will not damage your devices. You can read more about this in my cookie statement.
To enable reviews of my services, I process the content of your message and, if desired, your name and photo from the shoot. When you submit a review, this data becomes visible to me. I may publish reviews on my website and social media channels for commercial purposes. I will remove reviews when they are no longer representative of my services or upon your request.
If you contact me through the website, I request your name and email address. For a faster process, you may optionally provide your address, website, and Instagram account. Upon submission of the contact form, this information becomes visible to me. I delete contact form data once the inquiry has been resolved, unless an agreement results from it.
If you leave a comment on my articles or posts, I process your name, email address, optional gravatar, website, and the content of your message. This data becomes publicly visible and will be retained until you delete your comment or I delete the post.
When you register for one of my masterclasses, trainings, waiting lists, coaching programs, workshops, or free resources, I request your name and email address. This allows me to grant you access to the content and provide further information on the subject. I delete this data once the program or offering has been completed. If it concerns a paid masterclass, training, or workshop, I also process your invoicing details, which I retain for 7 years in accordance with tax regulations.
For your personal account in the academy, I process a password. This password is stored in encrypted form in combination with your email address and or username to prevent security fraud. I retain your account details and any comments you post in the community until you delete your account or no longer have access to the content.
Article 3 – How do I obtain this data?
The data described above has been obtained directly from you as a client or website visitor because you provided it to me.
Additionally, I may receive your data from one of my clients if you are present during a photoshoot and are photographed, or if you access a gallery containing content created for my client. I may also obtain your data if you are otherwise involved in the shoot or if a gift voucher is sent to you.
I make every effort to ensure that data relating to minors is only collected with parental consent. If you believe that I have collected personal data from a minor without such consent, please contact me.
Article 4 – What rights do you have?
Under the GDPR, you have the following rights regarding your personal data:
1. Access – You may request access to your personal data at any time.
2. Rectification – If your data is incorrect, incomplete, or outdated, you may request correction, supplementation, restriction, or deletion. Some data can also be adjusted in your personal account.
3. Objection – You may object to the processing of your data based on legitimate interest.
4. Data portability – If you wish to transfer your data to another provider, I will provide it in a structured, commonly used format that can be accessed by standard digital systems.
5. Withdrawal – If data processing is based on your explicit consent, you have the right to withdraw that consent. This may affect the services I can provide to you.
To exercise your rights, you may submit a request along with a copy of your identification (with your social security number and photo redacted) to [info@claudiadermois.nl](mailto:info@claudiadermois.nl). I will assess your request as soon as possible, but no later than 30 calendar days. If I cannot fulfill your request, I will inform you of the reason.
Article 5 – Who receives your data?
I do not share your data with third parties unless necessary for business operations or required by law. Your data may be shared with processors, parties involved in executing our agreement, and external advisors. This includes suppliers of photo products. I enter into data processing agreements with these third parties to ensure optimal protection of your privacy. I do not sell your data to third parties.
If I process your data outside the European Economic Area, I will implement appropriate safeguards.
Article 6 – Automated decision-making
I may use automated decision-making based on data you have provided, actions you have taken, or omissions. As a result, certain services may not or may no longer be available to you. You may always express your point of view regarding an automated decision and request that it be reviewed by a human.
